1. General

By using this site you confirm that you are at least 18 years of age and legally permitted to purchase our products in South Africa. We do not sell, deliver, or promote any products to individuals under 18.

2. Products and Services

• Availability: All products are subject to availability. We reserve the right to limit quantities of any product or service offered. Product descriptions and pricing may change at any time without prior notice, at our sole discretion.
• Product Use: Our products are for adults only and are not intended to diagnose, treat, cure or prevent any disease. Speak to a doctor before use if you are pregnant, breastfeeding, taking medication or have a medical condition. Keep out of reach of children and pets.
• Accuracy of Information: We aim to display product colours and images as accurately as possible. However, we cannot guarantee that your device's display will perfectly reflect actual colours.

3. Orders and Payment

• How ordering works: When you complete the order form, your order is sent to us on WhatsApp. Sending it is a request to buy, not a confirmed sale. Your order is only accepted once we confirm it in the WhatsApp chat.
• Prices: Prices are in South African Rand and include VAT. A minimum order and a flat delivery fee apply, as shown at checkout. If a price or stock level changes before we confirm, we will tell you in the chat before you pay.
• Payment: We will send payment details in the WhatsApp chat. Orders are dispatched once payment reflects. We may cancel orders that are not paid within 48 hours of confirmation.
• Order Acceptance: We reserve the right to refuse or cancel any order, including where we cannot verify that you are 18 or older, or where we suspect fraud. If you have already paid for a cancelled order, we will refund you in full.
• Accurate details: You agree to give us a correct name, WhatsApp number and delivery address. We are not responsible for failed deliveries caused by incorrect details.

4. Shipping and Delivery

• Shipping: We will make every effort to ship your order within the estimated time frame. However, we are not responsible for delays caused by third-party couriers or unforeseen circumstances.
• Risk of Loss: All items purchased from Sweet Mary Jane are shipped under a contract. Responsibility for the goods transfers to you once they are handed over to the delivery service.

6. Intellectual Property

• Ownership: All content on this site including text, graphics, logos, images, and software is the property of Sweet Mary Jane or its content providers and is protected by copyright and trademark laws.
• License: You are granted a limited, non-exclusive, revocable license to access and use the site for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works without our written consent.

7. Limitation of Liability

To the maximum extent permitted by law, Sweet Mary Jane is not liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, loss of profits, data, goodwill, or other intangible losses arising from:

• your use or inability to use the service;
• unauthorized access to or use of our servers or stored information;
• interruptions or transmission failures;
• viruses or harmful software transmitted by third parties;
• errors or omissions in content;
• or the conduct of third parties that is defamatory, offensive, or illegal.

8. Governing Law

These Terms of Service, along with any agreements under which we provide services, are governed by and interpreted in accordance with the laws of South Africa.

We reserve the right to update, modify, or replace any part of these terms at our discretion by posting changes on our website. It is your responsibility to review this page periodically. Continued use of our site or services after changes are posted constitutes acceptance of those changes.
